Investigators say Caleb Harrison Applegate crossed the center line on Highway 98 around 6:20 a.m. on October 2, hitting a Ford Ranger head-on. The truck, driven by 36-year-old Lee Thomas Sellers, flipped and caught fire. Sellers was pronounced dead at the scene.
A Texas state trooper reported smelling alcohol on Applegate, who allegedly denied driving. However, witnesses told officers they saw him behind the wheel.
If convicted, Applegate faces up to 20 years in prison. The case is assigned to Fifth District Judge Bill Miller.
